do i have the right to kick out my roommate?

Me and my friend vanessa just moved to orange county and we are renting out a luxury condominium (2 bed + loft). The last minute I needed someone to rent the master bedroom. So I found this guy on Craigslist. He sounded like a cool guy, so we decided to give him a try. We put his name on the least and finally met the guy. Its already been a month since living with him and we both want him out.
Reasons why: He’s 23 and doesnt know how to do anything and goes to me for everything and btw im 18. He talks to us as if everything is our fault and that he is better than us. He posts a paper saying were not allowed to have guest or family over after 10 on weekdays. (like wtf man) I find out that this guy is bi and when he brings his guest over, I hear their sex conversations from my room which is veryyy awkward. Me and Vanessa don’t get along with him at all and want him out. I already have people ready to take his room if he leaves. My landlord told me its our problem and that we have to settle it ourselves and that all he cares about is getting the rent money. Can I legally kick this guy out? and if i do does he have the right to do something about it?

    If technically you’re leasing the whole condo and he his leasing the room from you then I would say yes you do have the right.
    Considering the landlord has told you to take care of it that really gives you the choice to take whatever action you deem necassary.
    By the sound of it I would want him gone as well.
    I’m not sure about his right though, you would need to give him time to find other accomodation but if he prurposely takes a long time then just kick him out =P

    Why type of contract did you make with him? Up to my understanding it depends on the type of contract you made with him; check with a lawyer.

    I’m not sure bout america but in australia, once someone’s name is on the lease, then there is nothing you can do. He has just as much of a right to be there as you do. Sorry! In future, be more choosy about who you get to move in with you.
    Your gonig to have to wait untill the lease is up, then you’d have to argure bout who stays and goes….I think your’ve hung yourself by putting his name on the lease.

    No, you cannot kick the guy out. You all signed a lease with your landlord. He has as much right to stay there as you and your other roommate. If you kick him out, he could sue you.

    Did you put his name on the lease before or after you moved in? If all 3 of you moved in together, you are probably stuck legally. However if he moved in last after you signed the lease and your landlord added him because you asked him to, then you could probably get him kicked out.

    Honestly I would make life there unbearable for him to make him move out on his own volition.

    Hi,
    I believe it depends on the agreement on the lease. Tell me you have a copy. If you do reread it. Also I live in IL and it sounds like you live in CA? Not sure if there are different terms. Any lease can be different than others depending on who has written the lease agreement terms. Ask your landlord about the terms if you have any questions about it. That would be the best thing you can do when needing to understanding your lease. Second, ask your landlord if you are the head of the household on the lease since you did move in there first. This could give you a plus as far as having authority over this unwanted roommate and how you may be able to evict him. I understand you are in responsibility to “getting” rid of him yourself since your landlord doesnt want to deal with it but you have EVERY right to ask your landlord about the terms of this lease agreement so I’d make sure to ask him. Just tell him, “dont worry, i know it’s my responsibility however I have some questions” and ask them! GOOD luck and next time you have a roommate make sure you come up with an agreement of having authority to evict someone with months notice. GOOD LUCK hun!!
